K12 Plus – Terms of Use

Welcome to K12 Plus. These Terms of Use (“Terms”) govern your access to and use of the K12 Plus website and platform (collectively, the “Services”) operated by K12 Plus, LLC (“K12 Plus,” “we,” “our,” or “us”).

By accessing or using our Services, you agree to these Terms and our Privacy Policy.

1. Use of Services – You may use the Services only in compliance with these Terms and applicable laws. If you use the Services on behalf of a school district or organization, you represent that you are authorized to do so.

2. Relationship to Customer Agreements – If your school or organization has entered into a separate agreement with K12 Plus (such as a Master Services Agreement), that agreement governs your organization’s use of the platform. In the event of a conflict, that agreement controls.

3. Eligibility – You must be at least 13 years old to use the Services. Users under 18 must have supervision from a parent, guardian, or authorized school official.

4. Accounts and Security – You are responsible for: Maintaining the confidentiality of your credentials. All activity under your account. Promptly reporting unauthorized access.

5. Acceptable Use – You agree not to: Use the Services unlawfully. Access systems or data without authorization. Interfere with platform security or performance. Upload malicious or harmful content. Misuse student or confidential data.

6. Educational Use and Platform Purpose – K12 Plus provides software tools to support special education programs, including IEPs, Section 504, RTI/MTSS, and compliance workflows. The Services are intended for educational and administrative use by schools and authorized personnel.

7. Privacy Policy and Data Practices – Your use of the Services is subject to our Privacy Policy and Student Data Privacy Addendum, which explains how we collect, use, and protect information, By using the Services, you acknowledge that: Information may be collected through the website, platform, and communications. Data is used to operate, maintain, and improve the Services. Security measures are implemented to protect data .

8. Student Data and School Control -When the Services are used by schools: Schools retain ownership and control of student data. K12 Plus acts as a service provider and School Official under FERPA. Student data is processed only to provide educational services. K12 Plus does not sell student data or use it for advertising. Parents and students should contact their school for access, correction, or deletion requests.

9. Data Collection and Website Usage – When you visit our website, we may collect: IP address. Browser and device information. Pages visited and usage data. We may use cookies and analytics tools to improve functionality and user experience. You can control cookies through your browser settings.

10. Data Security – K12 Plus maintains a security program designed to protect data, including: Encryption in transit and at rest. Access controls and authentication. Monitoring and incident response. These safeguards align with industry standards and support secure handling of student and school data .

11. Data Sharing – K12 Plus does not sell personal information. We may share information: With schools and authorized users. With trusted service providers supporting infrastructure and security. When required by law. All third parties are required to maintain confidentiality and data protection standards .

12. Data Retention and Deletion – We retain data only as long as necessary to: Provide Services Meet legal and contractual obligations. Upon termination of services: Schools may request data export. Data may be securely deleted according to applicable agreements.

13. Third-Party Services – The Services may include links or integrations with third-party services. We are not responsible for their content or practices.

14. Intellectual Property – All content and technology in the Services are owned by or licensed to K12 Plus. You may not: Copy or distribute content without permission. Reverse engineer the platform. Use K12 Plus branding without authorization.

15. Service Availability -We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation. We may modify or update the Services at any time.

16. Disclaimer of Warranties – The Services are provided “as is” and “as available,” without warranties of any kind.

17. Limitation of Liability- To the fullest extent permitted by law: (a) Exclusion of Damages
K12 Plus will not be liable for indirect, incidental, consequential, or special damages, including loss of data, revenue, or profits. (b) Cap on Liability – K12 Plus’s total liability will not exceed: The amount paid for the Services in the 12 months preceding the claim, or $100 for free or trial use. (c) Basis of the Bargain- These limitations reflect a reasonable allocation of risk.

18. Indemnification – You agree to indemnify K12 Plus from claims arising from: Your use of the Services. Your violation of these Terms. Misuse of data or content.

19. Termination -We may suspend or terminate access: For violations of these Terms. Upon termination of a school or organization agreement. For security or legal reasons. 20. Changes to Terms and Privacy Policy. We may update these Terms and our Privacy Policy periodically. Updates will be posted on our website, and continued use constitutes acceptance.

21. Governing Law – These Terms are governed by the laws of the State of Texas.
